HCSO: Man shot by deputies at NW Harris County gas station had 'realistic' BB gun

HCSO originally said the suspect ignored orders to raise his hands and then pulled out a pistol and pointed it at the deputy.

HARRIS COUNTY, Texas — A man was shot by a Harris County deputy on Thursday at a northwest side gas station, according to Sheriff Ed Gonzalez.

Deputies responded to reports of a disturbance outside the gas station along FM 1960 at Ella Boulevard after multiple people called about a man pointing a gun at people and passing vehicles, HCSO said.

Deputies quickly spotted a guy matching the suspect’s description and ordered him to show his hands, according to HCSO's preliminary investigation. The sheriff's office identified the man as Juan Perez.

“The suspect reaches into his waistband, pulls a pistol and pointed it at the deputy,” HCSO Asst. Chief Tommy Diaz said at a news conference.

The deputy fired one shot -- hitting the suspect in the hip. KHOU 11 News obtained surveillance video of the shooting, which shows what officials said in the news conference.

“As soon as the suspect was struck, he started claiming that the gun was not a real pistol," Diaz said. "From what we see, it looked like a real gun."

On Friday, the sheriff's office said Perez had a "realistic replica Daisy BB gun."

The man was taken to an area hospital with non-life-threatening injuries, HCSO said.

No one else was hurt.

HCSO said Perez has been charged with aggravated assault on a public servant and two counts of aggravated assault with a deadly weapon.

HCSO is asking anyone who witnessed the incident before and during the shooting to call their non-emergency line at 713-221-6000.

Diaz said they'll release the body camera video as soon as possible.
