Spring father of 5 charged after holding cable saleswoman captive, sexually assaulting her, Pct. 4 says

After the judge set bond for Aloysius Gardner at $25,000, he became agitated and pleaded with her to lower it. "I have to be to work in two days," he said.

SPRING, Texas — A Spring man was arrested this week after a woman said he held her captive in his apartment and sexually assaulted her.

Aloysius Gardner, 39, appeared in court Thursday on charges of indecent sexual assault and unlawful restraint.

The victim was going door-to-door for a cable company when Gardner invited her inside his apartment on Dec. 6 to discuss internet services, prosecutors said.

The woman told police he began fondling her and then masturbating in front of her while forcing her to watch. She said she tried to leave several times but Gardner wouldn't let her.

He was arrested by Precinct 4 deputy constables.

According to prosecutors, Gardner has several previous convictions for violent offenses and violating a protective order.

His current charges are misdemeanors but prosecutors said they will likely be upgraded to attempted sexual assault, a felony.

The defense asked for a $2,500 bond but the judge set it at $25,000.

Gardner then became agitated and began pacing as the judge read the bond conditions.

He asked her if his bond was really $25,000 and she said yes.

The father of five then pleaded with her to lower it.

"Excuse me, judge, I work, I have to be to work in two days. I'm pleading my cause with you, can you lower my bond, please miss?" Gardner said.

Instead, she threatened to raise it so he quieted down.

Based on the allegations, prosecutors expect his charges to be upgraded to attempted sexual assault, a felony.
