Uvalde shooting survivors’ families sue UPS, FedEx for shipping weapon used by gunman at Robb Elementary

The legal case claims the companies shipped an enhanced trigger system that allowed the gunman to convert a firearm into a fully automatic or semi-automatic weapon.

UVALDE, Texas — Another lawsuit has been filed by families of survivors in Uvalde, and this time they are going after two package shipping companies for mailing the weapon used by the gunman.

According to our partners with the Texas Tribune, this lawsuit is going after UPS and FedEx. The big take away here is that the families allege they violated state and federal law. Specifically, when they shipped the weapon used by the shooter at Robb Elementary school.

This lawsuit was filed in a Bexar County District Court the same day two other wrongful death lawsuits were filed last month on May 24. It says the gunman was armed with a weapon ordered online on the day of the shooting.

The weapon was shipped to Oasis Firearms in Uvalde where the shooter picked it up from.

The suit claims the companies then shipped an enhanced trigger system to the guman’s house, which allowed him to upgrade the weapon. Families cited UPS conditions of carriage as proof of violation.

They also said the shipment to gunman’s house was a violation of school zone area protections.

Lastly, his age was mentioned. It claims the gunman was not 18 when he bought the gun.

UPS has responded to the suit.

In a statement, they told the Texas Tribune:

"Our hearts go out to the Uvalde victims and their families. Shipping firearms and components is highly regulated; UPS complies, and requires its customers to comply, with all applicable federal laws. The lawsuit has no merit and we will defend accordingly."

As for FedEx, they have not responded.
