A lawyer for State District Judge Woody Densen made the request during a hearing Monday morning.
Judge Densen is facing criminal mischief charges after he was caught on tape allegedly keying his neighbor's vehicle.
The neighbor says Denson vandalized his Range Rover twice in the Rice University area.
The judge allegedly caused about $3,000 in damage.
