HOUSTON — A man is seeking up to $250,000 in a lawsuit filed against the City of Houston after he hit a pothole and crashed his bike last year.
According to the lawsuit, the man claims he was riding his bike in a designated bike lane on Heights Boulevard north of the Waugh Bat Bridge on Nov. 1 around 9 p.m. when he hit a "massive pothole causing him to fall off his bicycle and strike his face on the pavement and sustain serious facial injuries."
The lawsuit claims that the City knew about the dangerous conditions in the bike lane because it had previously been reported and was also improperly repaired.
It also claims the City is negligent for:
- Failing to timely and adequately assess, inspect and report the dangerous condition of the hazard/defect
- Failing to temporarily repair a known hazard/defect
- Failing to adequately repair the known hazard/defect in a timely manner
- Failing to properly barricade the bike lane in which the hazard/defect existed
- Failing to follow policies and procedures regarding inspections of hazards/defects
- Failing to adequately and properly warn bicyclists of the hazard/defect
The man who filed the lawsuit wants to be compensated for medical bills, physical pain, mental anguish, physical impairment and physical disfigurement.
