HARRIS COUNTY, Texas — A 29-year-old man faces charges stemming from two nude videos shared of a former Lamar CISD teacher that were shot inside of an elementary classroom, according to court documents.
Nicholas Anthony Garcia is charged with unlawful disclosure of intimate visual material, according to those documents.
KHOU 11 News is not naming the former teacher because she has not committed a crime, but she did admit last week to taking nude videos of herself in the classroom to send to her ex-boyfriend.
According to the Harris County Precinct 2 Constable’s Office, the victim told an investigator that she had an argument with Garcia, who she had been in a relationship with for two years. After they broke up, the victim said she wanted a vehicle that they had purchased together back, but Garcia refused.
She said she had filed a report with a law enforcement agency to get the vehicle back, according to court documents. After that, the victim said she received a call from Garcia who told her that if he took the vehicle away from him, he was going to send the explicit videos to the school district.
The videos were two that the victim had sent Garcia while they were dating. The videos are said to be sexually explicit and were shot in a classroom. According to court documents, the victim’s face is visible and clearly identifiable.
The victim contacted Pct. 2 deputies. After speaking with the victim, investigators discovered that a press conference was being held.
The videos were sent to community activist Candice Matthews who called for the teacher to be held accountable for her actions.
“I’ve never sent this out to thousands of men, like, I’m not that type of person – this was just a relationship, a private matter, and he released it,” the former teacher said in an interview with KHOU 11.
The teacher who left the district in February said no students were in the classroom at the time the videos were taken.
“Anyone who sends that material out, promotes it for whatever purpose, put themselves in harm’s way and can be charged – and, in Texas, we do file these charges and pursue punishment pretty aggressively,” Carmen Roe, KHOU 11 Legal Analyst, said.
This is an ongoing investigation.
As of right now, Garcia hasn’t been arrested, but if convicted could face up to two years in prison and be fined up to $10,000.
