Man charged with capital murder in deadly shooting at Katy-area birthday party last month, court documents say

Court documents accuse Jaylon McIntyre, 25, of shooting and killing two of the victims – 24-year-old Nicholas King and 24-year-old Ellesha Rice.

HARRIS COUNTY, Texas — A 25-year-old man has been arrested and charged with capital murder after three people were shot and killed at a Katy-area birthday party in January, according to court documents.

Court documents accuse Jaylon McIntyre, 25, of shooting and killing two of the victims – 24-year-old Nicholas King and 24-year-old Ellesha Rice.

Harris County Sheriff Ed Gonzalez said on X, formerly Twitter, that McIntyre was originally booked on an aggravated assault charge, but it was ultimately upgraded to capital murder. Gonzalez said McIntyre was a party attendee.

It's unclear whether there were any other shooters or if anyone else will be charged.

What happened

At around 3 a..m. on January 21, three people were shot and killed at a birthday party that was being held at a short-term rental property on Russet Leaf Trace in West Harris County, according to Sheriff Ed Gonzalez. Two of the victims died at the scene and one died at an area hospital. At least one more person was also taken to a hospital for treatment.

The sheriff's office identified those killed as Michael Odobo, 24, Nicholas King, 24, and Ellesha Rice, 24.

At the time, Gonzalez described the situation as "very chaotic." 

"There's evidence inside the house and evidence along the street. It appears multiple, many shots were fired," he said that morning.

The sheriff said the evidence appears to show that at least one person was shooting from outside the house.
