Mother upset after daughter's accused killer is released from custody without ankle monitor

HARRIS COUNTY, Texas — A heartbroken mother is speaking out after her daughter's alleged killer was released from custody.

She's upset that 19-year-old Francisco Ochoa's bond was reduced and he was allowed to walk without an ankle monitor.

Arely Guzman said she's scared that Ochoa is out.

Jocelyn Espinoza, 24, was killed on Sept. 15. Investigators said she and Ochoa were dating and he shot her in the head.

"She was always kind to everyone," Guzman said.

Guzman said her daughter and Ochoa were in an abusive relationship.

"She was ready to end this relationship. I don't know if that was the reason he was upset -- no more control over her. He was done. Relationships are more dangerous when you are trying to break up with that person," she said.

According to court documents, the couple was arguing in a motel parking lot off the Beltway when surveillance video showed him get out of his truck. Espinoza, who was still in the truck, then locked the doors, prosecutors said.

Ochoa walked to her side of the truck and then, "using a firearm struck the window she was sitting in, causing the firearm to discharge," prosecutors said.

This week, Ochoa's bond was lowered from $200,000 to $50,000.

"It's an insult to my family. ... Not even consider an ankle monitor. So frustrating ... so upset," Guzman said.

The family is now worried that he's back on the streets while they're left burying their loved one.

"I was justice for her. She deserves it," Guzman said.

Ochoa is due back in court in December.

Espinoza's family is raising money for her funeral. She leaves behind a 7-year-old daughter.
