MONTGOMERY COUNTY, Texas – Deputies say a Subway restaurant's lost money bag appears to have been taken by a man and woman who found it in a cart at a Montgomery County Walmart.
The incident happened March 23 at 20310 US Hwy 59 in New Caney.
Managers at the Subway restaurant inside the Walmart said an employee placed the money bag, which contained cash and store documents, inside the shopping cart. The employee later transferred items from the cart to her vehicle but accidentally left behind the money and documents.
She later returned to the store when she realized her error, but the money was already gone.
Deputies reviewed Walmart’s video surveillance, and saw a man “wearing a blue shirt, a tan Splendora Wildcats hat and blue jeans pick up the blue money bag and carry it to his vehicle."
"The male suspect is seen retrieving the money bag from the cart at which time he opens the money bag. The male instead of returning the money to Subway or notifying law enforcement takes the money bag to his vehicle, which is described as a dark colored Ford F150. The male suspect was with an older female who pointed out the money bag was in the cart to the white male suspect when he took it," MCSO stated.
Video of the incident, which occurred March 23, was released Tuesday. That means the elderly man in the video held onto the money for nearly two weeks before returning it to the Subway sandwich shop.
Viewers have asked, “Can you keep money you find?” KHOU legal analyst Gerald Treece says the state of Texas is very clear on that answer.
“If you find something and you know its not yours, you have a duty to report it to the police or the establishment where you found it," he said.
It’s not clear how much money was in the envelope. The Montgomery County Sheriff’s Office says the couple is not facing any charges.
